High Court to hear FGV suit against Isa Samad, Emir in February-April

KUALA LUMPUR: The High Court here has fixed nine days between February and April 2020 to hear FGV Holdings Bhd’s suit against its former group chief executive officer Datuk Mohd Emir Mavani Abdullah and ex-chairman Tan Sri Mohd Isa Abdul Samad over the purchases of two luxury condominium units at above-market-value prices.

Yesterday, Mohd Isa’s lawyer Lavinia Kumaraendran told The Edge Financial Daily that Judicial Commissioner Quay Chew Soon has fixed Feb 3, 4, 7, 28, together with March 6, 9, 10, and April 1 and 2 as the trial dates.

Lavinia said Quay fixed the dates in chambers during case management. Quay has also fixed Jan 15 for further case management.

“There are over 20 witnesses from FGV, while Mohd Isa is expected to have five witnesses,” Lavinia said.

FGV claimed that Mohd Isa and Mohd Emir bought the condominium units at The Troika KLCC along Persiaran KLCC here at prices that were significantly above market value, and that the purchases were done without proper due diligence.

It also claimed there was unauthorised possession and use of the condominiums by Mohd Isa and Mohd Emir. The suit also involves the acquisitions by FGV of a number of cars and an allegation that Mohd Emir misused the company’s cars and petrol benefits.

It was reported on Nov 30, 2018 that FGV filed the suit to seek from Mohd Isa and Mohd Emir RM2.92 million for the acquisitions of the condominiums, and RM1.62 million for the possession and use of the residential units.

In addition, FGV is seeking RM3.14 million and RM10,837 from Mohd Emir in relation to the purchases of company cars and the use of petrol benefits, respectively.
